SQE1 Resit Promise (for courses starting September 2026)

For SQE Master’s and SQE Diploma programmes commencing in September 2026 only

These Additional Terms and Conditions apply to all Applicable SQE Programmes.

These Additional Terms and Conditions are in addition to the University Terms and Conditions that apply to the sale of any Applicable SQE Programme.

Please read these Additional Terms and Conditions and the University Terms and Conditions carefully before purchasing an Applicable SQE Programme which offers the SQE1 Resit Promise. Please print off or keep a copy of these Additional Terms and Conditions for your records. BPP University will not file or otherwise keep a copy of the agreement concluded between you and BPP University and a copy of the concluded agreement will not be available from BPP University at a future time and date.

By ordering an Applicable SQE Programme to which the SQE1 Resit Promise applies, you confirm your agreement to be bound by these Additional Terms and Conditions.

The SQE1 Resit Promise applies only to the external SQE1 Assessment (being FLK1 and/or FLK2 only) and does not apply to or entitle you to repeat or resit, any learning, tuition or internal assessment element of your Applicable SQE Programme.

If there is any conflict between these Additional Terms and Conditions and the University Terms and Conditions, these Additional Terms and Conditions shall prevail.

In these Terms and Conditions, “BPP University” means BPP University Limited of BPP House, Aldine Place, 142-144 Uxbridge Road, London W12 8AA, registered in England and Wales under company number 02609100, VAT registration number GB 115 1024 75, telephone number 03300 603 100.


1. Definitions

1.1.       Words and expressions defined in the University Terms and Conditions have the same meaning in these Additional Terms and Conditions except to the extent that they are varied by these Additional Terms and Conditions.

1.2.       In these Additional Terms and Conditions, the following terms have the following                 meanings:

Applicable SQE Programme” means the LLM SQE1&2, the SQE1&2 Diploma or the LLM Law Conversion with SQE1 delivered by BPP University with a start date in September 2026 only and does not include later cohorts or any SQE programme where a student accepted their place on that programme with an original start date earlier than 1 September 2026, and the student then subsequently deferred their Programme start date to September 2026;

Final Results” means a Qualifying Student’s final results of their First Attempt after all and any applications for mitigating circumstances and/or appeals have been determined;

First Attempt” means a Qualifying Student’s first attempt of the SQE1 Assessment or an FLK Paper (as the context may require), excluding any previous sitting which has been discounted by the SQE Assessment Provider pursuant to a successful appeal or mitigating circumstances application;

FLK1” means the first part of the SQE1 Assessment;

FLK2” means the second part of the SQE1 Assessment;

FLK Paper” means either FLK1 or FLK2;

Next SQE1 Sitting” means the first scheduled sitting of SQE1 following the release of a Qualifying Student’s Final Results from their First Attempt;

Prepaid Voucher” means a voucher which is sold by the SQE Assessment Provider on behalf of the SRA for the sole purpose of being used to pay for a specific SQE assessment or assessments;  

Qualifying Student” means any student who has purchased and participates in an Applicable SQE Programme and qualifies for the SQE1 Resit Promise pursuant to these Additional Terms and Conditions;

Quintile” means the performance metric used by the SRA in relation to the SQE which appears on an SQE candidate’s Transcript. This measures their performance relative to the rest of the cohort sitting that SQE assessment by grouping them into five equal size groups: the “1st Quintile” being the highest performing 20% of the cohort, the “2nd Quintile” being the next best performing 20% of the cohort, and so on, with the “5th Quintile” being the lowest performing 20% of the cohort;

Seat Reservation Form” means the form which candidates complete online during the Seat Reservation Window, which sets out their preferences as to the venue(s) and date(s) they wish to sit a specific SQE assessment;

Seat Reservation Window” means the period designated by the SRA for candidates to complete a Seat Reservation Form for a specific SQE assessment;

Second Attempt” means a Qualifying Student’s second attempt of the SQE1 Assessment or an FLK Paper as the context may require, having failed their First Attempt;

SQE1 Assessment” means the external assessment often referred to as ‘SQE1’ which is set by the SQE Assessment Provider;

SQE Assessment Provider” means Kaplan SQE Limited whilst such company is contracted by the SRA to develop, operate and deliver the SQE, and their successors in such role;

SQE1 Preparation” means the part of an Applicable SQE Programme which prepares BPP University students for the SQE1 Assessment;

SQE1 Resit Promise” means the provision by BPP University of a Prepaid Voucher to a Qualifying Student pursuant to these Additional Terms and Conditions;

SRA” means the Solicitors Regulation Authority;

Transcript” means the official transcript provided to candidates by the SRA recording a candidate’s performance in a particular SQE assessment; and

University Terms and Conditions” means the BPP University terms and conditions which apply to your Applicable SQE Programme, and which are available at https://www.bpp.com/terms-and-conditions.


2. SQE1 Resit Promise

2.1.       The provision of a Prepaid Voucher to a Qualifying Student pursuant to these Additional Terms and Conditions shall be known as the ‘SQE1 Resit Promise’.

2.2.       The purpose of these Additional Terms and Conditions is to set out:

  • the criteria which must be satisfied in order for you to be eligible for the SQE1 Resit Promise;

  • the process by which a Qualifying Student may apply for a Prepaid Voucher;

  • the terms upon which a Prepaid Voucher may be used by a Qualifying Student; and

  • the other terms and conditions which apply to the SQE1 Resit Promise.


3. Eligibility to be a Qualifying Student and for a Prepaid Voucher

3.1.       In order to be a Qualifying Student and to be eligible for the SQE1 Resit Promise, you must meet all of the criteria in this Paragraph 3.1, in addition to any specific requirements relating to your relevant Applicable SQE Programme under the University Terms and Conditions:

  •  By the scheduled end date of SQE1 Preparation in your Applicable SQE Programme, you must have attended SQE1 Preparation on either a full time or part time basis, either online or in person at one of BPP University’s centres in London, Birmingham, Bristol, Cambridge, Leeds or Manchester; and

  • Your attendance in live taught SQE1 Preparation workshops (online or in person) must have exceeded 80%; and

  • You must have attempted the formative and summative assessments during your Applicable SQE Programme; and

  • You must have sat both FLK Papers and failed either one or both of them on your First Attempt; and

  • To be eligible for a Prepaid Voucher to sit an FLK Paper at the Second Attempt:

o   the Transcript from your First Attempt must show:

i)  that you did not pass your First Attempt in one or both FLK Paper(s); and

ii) that you were placed in the 4th Quintile or better in the applicable FLK Paper(s); and

o   you must intend to sit your Second Attempt(s) of the FLK Paper(s) you did not pass, at the Next SQE1 Sitting.

WORKED EXAMPLE

If you did not pass either FLK Paper at the First Attempt and were placed in the 4th Quintile for FLK1 and the 5th Quintile for FLK2, provided you satisfy all the other eligibility criteria, BPP University would provide you with a Prepaid Voucher for your Second Attempt of FLK1 only at the Next SQE1 Sitting. BPP University would not fund your Second Attempt of FLK2.

3.2.       If you are a Qualifying Student, the value of the Prepaid Voucher to which you may be entitled shall be limited to the SQE Assessment Provider’s assessment fees at the Next SQE1 Sitting for your Second Attempt of the FLK Paper(s) which you did not pass at your First Attempt in which you were placed in the 4th Quintile or better.

3.3.       For the avoidance of any doubt, the SQE1 Resit Promise only applies to a Qualifying Student’s Second Attempt of an FLK Paper.

3.4.       The SQE1 Resit Promise will not apply to your Second Attempt of any FLK Paper any later than the Next SQE1 Sitting. 

3.5.       If you pay personally for your Second Attempt of any FLK Paper (or a third party does so on your behalf), or if you secure funding from any third party in respect of the same, you shall not be entitled to be reimbursed by BPP University in respect of any of such fees paid and will no longer be a Qualifying Student for the purposes of these Additional Terms and Conditions, even if you satisfy all the other eligibility criteria.

3.6.       If you fail to apply to redeem the SQE1 Resit Promise within the timescales set out in these Additional Terms and Conditions, or if you do not plan to sit your Second Attempt at the Next SQE1 Sitting, you will no longer be eligible to be a Qualifying Student.

3.7.       You will not be eligible for the SQE1 Resit Promise if, at the time of your First Attempt, you were sponsored by an employer (or future employer) and such employer (or future employer) paid your SQE1 Assessment fees for your First Attempt.

3.8.       The SQE1 Resit Promise does not apply to any part of the SQE2 Assessment.

3.9.       If you are provided with a Prepaid Voucher pursuant to these Additional Terms and Conditions, you may only use it for your own personal Second Attempt in the SQE1 sitting to which the Prepaid Voucher is designated. Consequently, any Prepaid Voucher you may receive is not transferable to any other student or third party, or to any later SQE1 sitting.

3.10.       Prepaid Vouchers and these Additional Terms and Conditions are subject to the SRA’s published Terms and Conditions for Voucher Purchase in force from time to time.

3.11.       BPP University reserves the right to offer the SQE1 Resit Promise to students who have passed an Applicable SQE Programme but who do not meet all of the requirements as a Qualifying Student for the SQE1 Resit Promise due to exceptional circumstances and in its sole discretion.


4. Procedure for Qualifying Students to claim a Prepaid Voucher

 

4.1.    A Qualifying Student who wishes to claim a Prepaid Voucher to fund their Second Attempt at the Next SQE1 Sitting shall:

 

  • complete and return to the SQE Assessment Provider or the SRA a Seat Reservation Form in respect of their Second Attempt by the end of the Seat Reservation Window for that sitting; and then

  • within 48 hours of receiving acknowledgement of receipt of the Seat Reservation Form from the SQE Assessment Provider or the SRA, send an email to sqevouchers@bpp.com stating: 1) their BPP Student Reference Number; and 2) written confirmation that they wish to redeem the SQE1 Resit Promise and attaching both:

1)         a copy of the SQE Assessment Provider or the SRA’s official acknowledgement of the submission of their Seat Reservation Form for their Second SQE1 Attempt; and

2)         a PDF copy of the Transcript from their First Attempt downloaded from their SQE online account.      

4.2.              If you are a Qualifying Student and you satisfy all the requirements of Paragraph 4.1 within the time limits prescribed therein, BPP University will, within 21 days from receipt of your email, send to you a unique code for your Prepaid Voucher (“Code”), the value of which will be determined in accordance with Paragraph 3.2.

4.3.              When you receive the Code, you must promptly, within the time limits prescribed to you directly by the SQE Assessment Provider or the SRA, use the Code to pay for your Second Attempt of the relevant FLK Paper(s), following which you shall receive a booking confirmation or payment receipt.

4.4.              Within 48 hours of the booking confirmation or payment receipt from the SQE Assessment Provider or the SRA, you must send a copy of such receipt or confirmation to sqevouchers@bpp.com.

4.5.              If you receive a Code from BPP University for your Prepaid Voucher and do not use it at the Next SQE1 Sitting, you will no longer be eligible for the SQE1 Resit Promise. You must email sqevouchers@bpp.com without delay and provide an explanation as to why you have not used it.

WORKED EXAMPLE

If your First Attempt of SQE1 was in January 2027, you would expect to receive your results in March 2027, meaning that your Next SQE1 Sitting would be in July 2027. The Seat Reservation Forms for the July 2027 SQE1 sitting are expected to be sent in early April 2027, the booking window for which is expected to close in late May 2027. 


5. General

5.1.       In the event that:

  • the SRA discontinues its provision of Prepaid Vouchers to BPP University; or

  • if you are a Qualifying Student in receipt of a Code and do not use it to book for your Second Attempt;

BPP University will not:

(i)                           refund any part of your Programme Fees or provide a cash alternative to the SQE1 Resit Promise in any circumstances; or

(ii)                        provide you with another Prepaid Voucher for any later SQE1 sitting unless exceptional circumstances apply (to be determined at the discretion of BPP University) and this is agreed with you in writing.

5.2.       Neither the SQE1 Resit Promise nor the Prepaid Voucher includes any travel or accommodation costs which you may incur in connection with your Second Attempt, nor any part of the cost of your Second Attempt which is not covered by the Prepaid Voucher.  In particular, any SQE1 Assessment fees for your Second Attempt which are not covered by a Prepaid Voucher shall at all times be payable by you.

5.3.       BPP University shall only be obliged to provide a Prepaid Voucher to Qualifying Students pursuant to these Additional Terms and Conditions relating to the SQE1 Resit Promise, which for the avoidance of doubt does not include any additional tuition or learning materials.

5.4.       In the event that you: (i) cancel your place on the Applicable SQE Programme after having accepted that place; (ii) withdraw from the Applicable SQE Programme at any time during such Programme; and/or (iii) are withdrawn from the Applicable SQE Programme at any time; you shall no longer be entitled to redeem the SQE1 Resit Promise. 

5.5.       BPP University reserves the right to withdraw the SQE1 Resit Promise at any time without notice. However, the SQE1 Resit Promise will not be withdrawn from you where you are already enrolled on an Applicable SQE Programme at the time of such withdrawal.

5.6.       The SQE1 Resit Promise is not transferable by you to any third party and no cash alternative will be offered.

5.7.       BPP University will process the information it receives from you or otherwise holds about you in accordance with these Additional Terms and Conditions, the University Terms and Conditions and its privacy policy, which is available at www.bpp.com/privacy.

5.8.       BPP University shall not be liable to you for any financial loss arising out of the refusal, cancellation or withdrawal of the SQE1 Resit Promise or any failure or inability by you to redeem the SQE1 Resit Promise for any reason.

5.9.       BPP University may amend these Additional Terms and Conditions from time to time to comply with any applicable law or regulation, or in order to meet its reasonable business requirements from time to time without notice to you. Any updates or amendments to these Additional Terms and Conditions will be posted on BPP University’s website.

5.10.       These Additional Terms and Conditions and any other matters arising out of or in relation to these Additional Terms and Conditions, shall be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the English courts to settle any dispute which may arise out of or in connection with these Additional Terms and Conditions.
